RAC Privacy Policy
Your privacy and the privacy of your personal information are very important to us and this policy outlines how we collect, use and disclose your personal information.
The Royal Automobile Club of Western Australia Inc (ABN 33 212 133 120) and its related and subsidiary companies, including companies such as RAC Insurance Pty Ltd, and businesses not using RAC as their primary brand, collect and handle your personal information in accordance with the Australian Privacy Principles (APP’s), under the Privacy Act 1988 (Cth).
For the purposes of this policy, the term “RAC”, “we” or “us” means either The Royal Automobile Club of Western Australia Inc and its related and subsidiary companies, or any one of those entities, as the case may be, unless otherwise noted.
By providing your personal information to us, you agree to our collection, use, and disclosure of your personal information (including sensitive information such as health information) in accordance with this privacy policy.

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable: (a) whether the information or opinion is true or not; and (b) whether the information or opinion is recorded in a material form or not.
Sensitive personal information includes information or an opinion about matters like your health, criminal history or racial or ethnic origin. In limited circumstances, we need to collect this information from you to assist you. For example, we may need to collect information about your health so RAC travel can arrange travel insurance for you. We will not collect sensitive information about you unless you consent to the collection and the information is directly related to our activities.
Many of our products and services require you to give us personal information such as your name, address, telephone number, email address and credit card number, either to store within your member account, or to help us or third party agents, contractors or organisations engaged by us to provide to you our products or services.
We normally collect personal information directly from you over the phone, face-to-face in an RAC Member Service Centre or agency, through the mail using paper application forms or electronically over the internet, through RAC mobile apps or other communication tools. However, in some circumstances, we collect personal information from a third party.
RAC also obtains personal information through the use of website analytics tools, on where, when and how you use our products and services and to authenticate your access to products and services from us and our service providers and agents.

Where practical we will give you the option of not identifying yourself, or using a pseudonym, when dealing with us. However, the nature of our business may mean that, if you do not provide us with the personal information we need, we will be unable to administer and manage the product or service that you wish to purchase. We will also be unable to assess your application, where one is required, for example to purchase an insurance policy or arrange a personal loan. We will advise you if your failure to provide personal information may jeopardise your application.
We use your personal information in the course of administering and managing the products or services you have with us, including for marketing and promotional purposes and dealing with any complaints or claims.
We may need to disclose some of your personal information to other people or organisations who assist us to provide you with products and services. This may include entities within the RAC or third party agents, contractors or organisations.

Also, within the RAC and our third party suppliers, we share information to help us provide you with more efficient service and to keep you informed about RAC and other non-branded products and services. We may use your personal information to conduct direct marketing, such as telemarketing and advertising via email, SMS or post, in order tell you about RAC and other non-branded products and services.
The type of personal information we use or disclose will depend on the product or services being offered, but will usually be limited to your name and contact details. Importantly, we will not use any sensitive personal information for marketing purposes without your express consent. We do not sell, trade, lease or rent any personal information we obtain without your prior express consent.
Your personal information may be passed to other entities (including third party entities) for promotional purposes, including direct marketing. Those entities may use the personal information we provide to them to market to you, including by sending you information or contacting you (by telephone, post or electronically) about RAC, RAC branded third party products or services or non-branded products and services. These entities may be associated with Us, operate under the RAC’s Brand or be third party agents, contractors or organisations.
You may choose to opt out of our marketing activities at any time by advising us via the unsubscribe function or other contact information provided in any marketing you receive. Alternatively, you may advise us by speaking to one of our Sales and Service Consultants at any RAC Member Service Centre, or calling us on 13 17 03.
Sometimes our third party agents, contractors or organisations are based overseas, or otherwise have data storage facilities overseas where your personal information will be stored. We may transfer information about you between countries if required for a relevant purpose described above.
We will take reasonable steps to ensure all overseas entities to whom we transfer your personal information do not breach the Australian Privacy Act 1988 (Cth) and APP’s, including ensuring commercially reasonable and industry standard security measures are taken by those entities to protect your personal information from unauthorised access and use.

1 Who Are We
Your privacy is important to the Australian Football League (ABN 97 489 912 318) (AFL) and each of the 18 AFL Clubs listed in paragraph 12 of this Privacy Policy (AFL Clubs). This Privacy Policy provides information about the personal information that the AFL and AFL Clubs collect and the ways in which the AFL and AFL Clubs may use, hold and disclose this personal information.
The AFL may disclose your personal information to AFL Clubs, and AFL Clubs may disclose your personal information to the AFL. Each organisation will collect and use your personal information in accordance with this Privacy Policy.
When used in this document, depending on the context, "we," "our" and "us" refers to AFL and/or the AFL Clubs.
2 AFL and AFL Clubs Privacy Policy
Protecting personal information is fundamental to the AFL’s and AFL Clubs’ relationship with our supporters, employees, players and business partners. All personal information received in connection with an AFL or AFL Club product or service, or in the conduct of the AFL’s or AFL Clubs’ business, is therefore treated seriously, having regard to the AFL’s and the AFL Clubs’ legal obligations.
Personal information is information that identifies you or could identify you. The AFL and AFL Clubs are subject to the Privacy Act 1988 (Cth), including the Australian Privacy Principles.
3 Information Collected
Generally, the AFL and the AFL Clubs collect personal information directly from you via your use of the products and services on offer, use of AFL Online (defined in paragraph 9 of this Privacy Policy below) and any registration you make to participate with or receive information from, the AFL or your AFL Club and any business relationship between you and us, including via email. 4 Opt-Out/Unsubscribe
You can easily unsubscribe at any time you want to our communications by contacting us using the contact details specified in paragraph 11 of this Privacy Policy or by following the instructions contained in an e-mail.
It may take some time to put an opt-out or an unsubscribe in effect so you may still receive communications from us for several weeks after your request is received.
For the avoidance of doubt, by opting–out or unsubscribing yourself from a mailing list of an AFL or AFL Club product or service this will ensure your removal from that particular mailing list but will not guarantee your removal from other mailing lists that the AFL or an AFL Club may store your details in as a result of your engagement with a different service or product.
5 Information from Third Parties
During the course of business, the AFL and AFL Clubs may also collect personal information that is given to them by a third party (for example, a corporate partner of the AFL or AFL Clubs or information that is on a publicly maintained record). This information forms part of the personal information described in this Privacy Policy. The AFL and AFL Clubs will not intentionally solicit personal information that is unintentionally disclosed.
We may also receive information about you from third parties in relation to other websites. For example, you may choose to participate in a third party application or feature as part of our services (such as logging in through Facebook Connect or Google+ or otherwise linking to the services from another website or interactive service) or on a third party website or service (such as a Facebook application or a similar application or feature) through which you allow us to collect (or the third party to share) information about you, including personal information. When you choose to participate, you may be opting to link your activity on AFL Online services with that third party website or service, which may then collect information about your visits to AFL Online and may publish that activity as you request to your "profile" or similar feature with that third party (such as if you choose to share content you find on AFL Online with your "connections" on the third party's website or service).
The information we collect is subject to this Privacy Policy. However, the information collected and stored by the third party remains subject to the third party's privacy practices, including whether the third party continues to share information with us or with other third parties, the types of information shared, and your choices with regard to what is visible to others on that third party's website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but we may retain the information previously collected. In addition, we may receive information about you if other users of a third party website or service give us access to their profiles and you are one of their "connections" or information about you is otherwise accessible through your "connections'" web page, profile page, or similar page on a social networking or other third party website or interactive service.
6 Public Forums, Refer a Friend, and Customer Testimonials
The AFL and AFL Clubs may provide bulletin boards, blogs, or chat rooms on AFL Online or mobile applications. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. The AFL and AFL Clubs are not responsible for the personal information you choose to submit in these forums.
7 Storage of Personal Information
Wherever reasonably practicable, the AFL and AFL Clubs will store personal information on data servers that are owned and controlled by the AFL and AFL Clubs and are located within the geographical borders of Australia. However, some of your personal information may be transferred, stored, processed, used or disclosed overseas by the AFL or AFL Clubs, or by the AFL's or AFL Clubs' third party service providers. In particular, at the date this Privacy Policy was most recently updated, your personal information may be disclosed to recipients in the USA, Gibraltar, China and other countries from time to time.
This may happen if our service providers are located overseas, or if transactions, information, services or products have an overseas connection. Where such parties are located overseas, you may have rights to enforce such parties' compliance with applicable data protection laws, but you may not have recourse against those parties under the Australian Privacy Act (Cth) 1988 in relation to how those parties treat your personal information.
You agree to the disclosure and use of such personal information in accordance with this Privacy Policy, and consent to its disclosure overseas and its use by third parties, including our service providers, in the USA, Gibraltar, China and such other countries in which those parties or their computer systems may be located from time to time, where it may be used solely for the purposes described in this Privacy Policy, without us being responsible for such use (or for any breach). Where the AFL and AFL Clubs use cloud computing services we will use our reasonable endeavours to ensure that such disclosures are in compliance with Australian privacy laws.
8 Use and Disclosure of Personal Information
The AFL and AFL Clubs collect, hold, use and disclose your personal information for purposes including, without limitation:

Where you provide your personal information directly to one AFL Club, although it may be disclosed to the AFL, that personal information will not ordinarily be shared with a different AFL Club. For example, if in a transaction you purchase merchandise relating to two AFL Clubs, that transaction may be disclosed to both AFL Clubs.
You consent to the AFL and AFL Clubs using your personal information for sending you information, including promotional material, about the AFL or AFL Clubs, or the AFL or AFL Clubs' products and services, as well as the products and services of selected third parties, now and in the future. You also consent to us contacting you with such information by means of direct mail, email, SMS, MMS messages, social media and via telephone.
Sharing Information With Third Parties
We engage third parties to perform services in connection with the operation of our business. Examples of these services include payment processing and authorisation, fraud protection and credit risk reduction, product customisation, order fulfilment and shipping, marketing and promotional material distribution, website evaluation, data analysis and, where applicable, data cleansing.
We may need to share personal information with these third parties so that they can perform these services, however, we limit the personal information that we give to them and authorise them to use this information only for the purpose of performing those services.
We may share aggregated demographic information about our user base with our agents, including agencies or third party vendors so that they can provide marketing analysis and consult on advertising strategies. 9 Accessing AFL Online
“AFL Online” refers to the AFL website with its top-level domain located at http://www.afl.com.au/, all related sub-domains and any other AFL website (including any AFL Club website) which provides an AFL and AFL Club product, AFL and AFL Club service or AFL-related product or service including related mobile applications. You need not disclose your identity to the AFL or AFL Club in order to visit AFL Online, except where personal information is voluntarily supplied, however the AFL or AFL Club internet server may automatically record details about any computer used to access the website (such as the IP address, domain name and browser type), the date and time of access, and details of the information downloaded. This information is used for internal statistical purposes and to improve AFL Online.

The AFL or AFL Clubs may use “cookies” on AFL Online. A cookie is a small text file that AFL Online may place on your computer. Usually, cookies are used as a means for our websites to remember your preferences and are thus designed to improve your experience of AFL Online. If you are under 18, you should only use AFL Online with involvement of a parent or guardian. For their protection, we ask that anyone under 18 years of age does not attempt to register with AFL Online or otherwise provide us with any personal information without the consent of a parent or legal guardian.
10 Information Security
The AFL and AFL Clubs will take reasonable steps to protect all personal information within their direct control from misuse, interference, loss, unauthorised access, modification or disclosure. The AFL and AFL Clubs will take reasonable steps to hold information securely in electronic or physical form in access controlled premises or in electronic databases requiring logins and passwords.
11 Notifiable Data Breaches Scheme
In the event of any loss, or unauthorised access or disclosure of your personal information that is likely to result in serious harm to you, the AFL and/or AFL Clubs will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with the Privacy Act 1988 (Cth).
12 Contacting Us Regarding Access, Correction and Privacy Complaints
The privacy laws of some jurisdictions give individuals the right to access, amend or delete their personal information or, in some circumstances, to restrict or object to the processing of their personal information.

Competition Terms & Conditions
RAC West Coast Eagles National Road Safety Week 2024 Promotion
TERMS AND CONDITIONS
1. The promoter of the RAC West Coast Eagles National Road Safety Week Promotion (Competition) is Royal Automobile Club of Western Australia 33 212 133 120 (the Promoter).
2. The Competition begins on Saturday 4 May 2024 at 10.00am (Australian Western Standard Time) and ends on Sunday 6 May 2024 at 11.59pm (Australian Western Standard Time) (Competition Period).
3. Entries must be received by the Promoter during the Competition Period. Only one entry may be received per entrant.
4. The Promoter reserves the right to either allow or disallow any entrant for any reason it sees fit in its absolute discretion.
5. Entry to the Competition open to any resident of Western Australia.
6. Entry to the Competition is not open to employees of the RAC Group of Companies
7. Up to 1 entrants (Winner/s) may each be awarded only one prize (Prizes) as follows: one $500 RAC Parks & Resorts voucher. Voucher is subject to terms and conditions of use and expiry.
8. This document, the instructions on how to enter the Competition and other details contained within promotional advertisements and the Entry Form (if applicable), each form part of the Terms and Conditions.
9. The Winner/s shall be chosen by the Judges from the entries at random.
10. The Winner/s will be drawn on Wednesday 8 May 2024and notified by writing.
11. When the Winner/s are notified of their Prize they will also be provided with details as to the collection of their Prize.
12. The Judges’ decision is final and no correspondence will be entered into. The Promoter reserves the right not to select Winners of all or any Prizes in its absolute discretion.
13. Each Winner must claim its Prize on or before Friday 10 May 2024. Prizes must be claimed in person unless a Winner is otherwise advised. Identification, which includes a photograph, will be required. Prizes will only be awarded following winner validation and verification.
14. A Prize must be taken as stated and is non-transferable, not exchangeable and not redeemable for cash. If the specified prize becomes unavailable for any reason, the Promoter may substitute a prize at its discretion.
15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
16. The Promoter reserves the right to disqualify a Winner if the Winner has breached any of the Terms and Conditions or their entry is misleading.
17. The Promoter reserves the right to:
a. declare as void any entries or claims for Prizes resulting from any printing, production or distribution errors or where there has been error in any aspect of the preparation for or conduct of the Competition materially affecting the result of the Competition or the number of Winners or the value of claims for Prizes;
b. add to or to waive any of the Terms and Conditions; and
c. cancel the Competition or any part of it at any stage in the event of circumstances beyond the Promoter’s control.
18. The Promoter reserves the right, in its sole discretion, to disqualify any individual for:
a. tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the promotion or the website of the Promoter or the Competition;
b. acting in violation of the Terms and Conditions.
19. Participation in the Competition constitutes the entrant’s unconditional agreement to and acceptance of the Terms and Conditions.
20. All entries remain the property of the Promoter and may be entered into a database for future marketing or promotional activities. By entering the Competition entrants, in the event that they are a Winner, consent to the publishing of their names and suburb of residence on the website www.rac.com.au. Acceptance of a Prize by a Winner constitutes permission for the Promoter to use the Winner’s name, suburb of residence, recording of the Winner’s voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law. The Promoter will not use the entrants’ personal information for any other purpose without their consent unless required or authorised to do so by law. Entrants must notify the Promoter in writing if they would like to amend their personal information or if they have any queries as to how their personal information will be used.
21. This Competition is subject to the Promoter’s Privacy and Security Statement and Group Privacy Policy.

If the Competition is conducted on, or utilising, social media including, without limitation Facebook, Instagram and Twitter, the Competition shall be subject to the terms of use governing the applicable social media platform including the RAC User Generated Content Policy. In the event of an inconsistency between these Terms and Conditions, and the terms of use of the applicable social media tool, the terms of the applicable social media tool shall prevail.
23. Without prejudice to clause 22 above, if the Competition is conducted on Facebook or Instagram, entrants:
a. fully release Facebook or Instagram from all liability arising out of the Competition;
b. acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram; and
c. understand and accept that information disclosed in connection with the Competition is disclosed to the Promoter and not Facebook or Instagram
