Official Rules
2020-21 Coyotes Season Ticket Member Gift Giveaway
1. General. By participating in the 2020-21 Coyotes Season Ticket Member Gift Giveaway (the “Giveaway”) through a legitimate claim to a Giveaway Card, which shall consist of a virtual scratcher, spin to win, or some other form of gift reveal provided by the Arizona Coyotes (each, a “Giveaway Card”), Participants agree to be bound by these Official Rules and by the decisions of the Arizona Coyotes (the “Coyotes”), which shall be binding and final as to all matters related to the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws (and, as applicable to Canadian residents, Canadian laws) and is void where prohibited.
2. Eligibility. The Giveaway is open to a maximum of one (1) individual per Coyotes ticket account who is the primary account holder of an eligible 2019-20 Coyotes ticket membership package (i.e., full season, half season, weekender) and either renews or purchases an eligible 2020-21 Coyotes ticket membership package (i.e., full season, half season, weekender) by the end of each giveaway period, as defined below, and complies with these Official Rules, as determined in the Coyotes’ sole discretion (each, an “Eligible Participant”). There are four (4) giveaway periods – (i) April 28, 2020-May 1, 2020; (ii) May 4, 2020-May 8, 2020; (iii) May 11, 2020-May 15, 2020; and (iv) May 18, 2020-May 22, 2020 (each, a “Giveaway Period”). Maximum of four (4) total Giveaway Cards per Eligible Participant – each individual who becomes an Eligible Participant by May 1, 2020 may receive up to four (4) total Giveaway Cards; each individual who becomes an Eligible Participant by May 8, 2020 may receive up to three (3) total Giveaway Cards; each individual who becomes an Eligible Participant by May 15, 2020 may receive up to two (2) total Giveaway Cards; and each individual who becomes an Eligible Participant by May 22, 2020 may receive up to one (1) total Giveaway Card.
3. The Giveaway. Giveaway Cards will be provided by the Coyotes to Eligible Participants as described above. Giveaway Cards which are, or appear to be, tampered with are void. The Coyotes shall be the sole judge of the validity and eligibility of all Giveaway Cards. All Giveaway Card results shall be final. Credits, vouchers, discount offers, prize packs, hockey game tickets, etc. that are included on Giveaway Cards are only valid pursuant to the terms and conditions provided by the Coyotes, and, as applicable, the corresponding business provider, at its sole discretion (e.g., game eligibility, seat location, credit amount, no cash back on credit to ticket accounts, ability to apply a ticket account credit to an account, other use restrictions, etc.).
4. Gifts. Each Giveaway Card will include some sort of credit, voucher, discount offer, prize pack, hockey game ticket, etc. as determined by the Coyotes (each item, a “Gift”), which may only be claimed by the Eligible Participant that receives the Giveaway Card from the Coyotes, and all of which are subject to the applicable terms and conditions as determined by the Coyotes.
5. Gift Claim. Each Participant must provide the Coyotes with all information required by the Coyotes to claim a Gift before the deadline established by the Coyotes. The Gift claimant may receive an Affidavit, Prize Claim, and Release (“Release”), which, if required by the Coyotes, must be executed and returned to the Coyotes by the established deadline. In the event that a Participant: (a) does not notify the Coyotes by the established deadline; (b) is ruled ineligible for any reason; (c) refuses the Gift(s); or (d) does not return an executed Release, the Gift(s) will be forfeited. The Coyotes have no obligation to contact Participants.
6. No Transfer of Giveaway Card or Gift. Participants may not transfer (e.g., give away, sell, etc.) their Giveaway Card or a Gift to any other person. All Giveaway Cards and Gifts which have been transferred in violation of these Official Rules shall be void. All individuals who give away, sell, purchase, or receive a Giveaway Card in violation of these Official Rules shall be ineligible to participate in the Giveaway or claim a Gift.
7. Taxes. Each Eligible Participant shall be responsible for any and all federal, state, provincial, and local income or excise taxes, fees, assessments and like charges associated with a Gift.
8. Judges. The Giveaway will be conducted and supervised by the Coyotes, the decisions of which are final. The Coyotes reserve the right to modify these Official Rules at any time. The Coyotes also reserve the right, in their sole discretion, to cancel or suspend the Giveaway.
9. Release of Liability. By participating in the Giveaway, all Participants agree to: (a) be bound by these Official Rules; and (b) release IceArizona Hockey Co LLC d/b/a the Arizona Coyotes, IceArizona Holdings LLC, the National Hockey League and its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., the NHLPA, Gila River Arena, ASM Global, the City of Glendale, and each of their respective parent corporations, subsidiaries, together with their owners, sponsors, advertisers, partners, affiliates, directors, officers, officials, agents, volunteers, contractors, and employees, (the “Released Parties”) from any and all liability with respect to any and all claims, injuries, damages, losses and liabilities that may occur, directly or indirectly, in whole or in part, from the participation in the Giveaway, including without limitation any and all liability (including, but not limited to, negligence) for property damages or personal injuries (including, but not limited to, the consequences of such injuries, such as death) with respect to acceptance, possession, or use of the Gift or from any travel or activity related to the receipt or use of any Gift.
10. Publicity Release. Each Participant, by accepting a Gift, grants the Released Parties full permission, except where legally prohibited, to use such Participant’s name, address (city and state only), photograph, voice and/or other likeness, and Gift information for advertising, trade and Giveaway purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide and in perpetuity. Each Participant who desires to claim their Giveaway Card Gift(s) shall execute all documents that the Coyotes require to be signed in connection with this release.
11. General Conditions. Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions or e-mail or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, app, or other connections including those through and/or by any website or app, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; any error, omission, interruption, defect or delay in transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed e-mail notifications, printing, typographical or other errors appearing within these Official Rules, in any Giveaway-related advertisements or other materials, or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with the Giveaway, including, without limitation, errors or difficulties which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of a Gift or in any Giveaway-related materials, or the cancellation or postponement of any game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway. Released Parties are not responsible for injury or damage to Participants’, or to any other person’s, computer related to or resulting from participating in the Giveaway or downloading materials from or use of a website. The Coyotes are not responsible for any other costs or expenses required to accept, claim, or use any Gift (e.g., remaining balance due after credit/discount, any transportation, parking, food and beverage, etc.), which shall all be the sole responsibility of the Gift claimant. Persons who tamper with or abuse any aspect of the Giveaway or attempt to undermine the legitimate operation of the Giveaway by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other Participant or any representative of the Coyotes and/or the Released Parties or who are in violation of these Official Rules, as solely determined by the Coyotes, will be disqualified and all associated Giveaway Cards will be void. Any attempt to deliberately damage the content or operation of the Giveaway is unlawful and subject to legal action by the Released Parties. The Coyotes shall have the sole right to (i) disqualify a Participant for violation of these Official Rules or any applicable laws relating to the Giveaway, and (ii) resolve all disputes in its sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Gift (or any portion thereof); and (ii) disclaim any implied warranty. The Coyotes’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY DAMAGE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE COYOTES WILL DISQUALIFY ANY SUCH PERSON, AND THE RELEASED PARTIES RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS’ FEES AND COSTS) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Governing Law. The Giveaway and these Official Rules shall be subject to and governed by the laws of the State of Arizona. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules shall remain enforceable to the fullest extent permitted by law. The venue for any cause of action arising out of the Giveaway or these Official Rules shall be located in Maricopa County, Arizona.
