Name of Competition: Kick Your Way to L.A
Promoter: Adelaide Football Club (‘AFC’)
Entry Requirements: Entry is only open to all Australian residents.
Ineligible Entrants: Employees and their immediate families of the Promoter, relat-ed companies of the Promoter and agencies associated with this promotion are ineligible to enter.
Competition Period
The promotion commences at 12:00pm (ACST) on 11 March 2024 and closes at 12:00pm (ACST) 11 August 2024.
Entry Method
To enter the promotion the entrant must complete the data in-formation form associated to the competition. This includes name, contact number, email and confirmation of attending Adelaide Oval.
Entries can be submitted when joining through the following additional channels during the
Competition Period:
- Facebook advertising
- Instagram advertising
- Links provided in promotion via email from Adelaide Football Club
- Official form entries
- Plus, via other channels specifically promoting this competition.
By entering the competition, each entrant agrees to the Conditions of Entry and gives consent to participate in any promo-tional activities (such as publicity and photography) and the use of their name and/or image in any promotional material.
Maximum Number of Entries Participants can enter as many times as they like.

The prize winners will be contacted by telephone initially, followed by confirmation via email, using the contact details sup-plied at the time of entry.
Prize Delivery:

Each winning Entrant will be publicly announced on the Adelaide Crows’ official social media platforms.
If the winner is unable to attend or does not respond with 24 hours of bring contacted by the Adelaide Football Club, the prize will be redrawn.

Each Australian Football Body will collect and use your personal information in accordance with this Privacy Policy.
When used in this document, depending on the context, "we," "our" and "us" refers to AFL and/or State Leagues and the AFL Clubs.
2 AFL Football Bodies Privacy Policy
Protecting personal information is fundamental to the Australian Football Bodies’ relationship with our supporter, members, players and business partners. All personal information received in connection with the Australian Football Bodies’ products or services, or in the conduct of the Australian Football Bodiess’ business, is therefore treated seriously, having regard to the Australian Football Bodies’ legal obligations.
Personal information is information that identifies you or could identify you. The AFL and AFL Clubs are subject to the Privacy Act 1988 (Cth), including the Australian Privacy Principles.
3 Information Collected
Generally, the Australian Football Bodies collect personal information directly from your use of the AFL’s community football administration platform provider and any registration you make to participate with or receive information from, the Australian Football Bodies and any business relationship between you and us including via email. The personal information which the Australian Football Bodies collect and hold includes:

We may also collect information about you which is considered sensitive under applicable privacy and data protection laws. Generally, we will ask for your consent to handle your health or other sensitive information or, in certain circumstances, you will consent to our collection by providing your health or other sensitive information to us.
Where we engage with you multiple times over a short period in relation to the same matter, we may not provide you with a separate notice about privacy each time we engage with you however we will always provide you with an opportunity to opt–out of receiving communications about that matter within each of those communications.
4 Opt-Out/Unsubscribe
You can easily unsubscribe at any time you want to our communications by contacting us using the contact details specified in paragraph 11 of this Privacy Policy or by following the instructions contained in an e-mail.
It may take some time to put an opt-out or an unsubscribe in effect so you may still receive communications from us for several weeks after your request is received.
For the avoidance of doubt, by opting–out or unsubscribing yourself from a mailing list of an AFL or AFL Club product or service this will ensure your removal from that particular mailing list but will not guarantee your removal from other mailing lists that the AFL or an AFL Club may store your details in as a result of your engagement with a different service or product.
In the event that you opt-out from receiving communications from the Australian Football Bodies you will still be contacted in relation to the administration of your player registration (for example team lists, change of venue etc).
5 Information from Third Parties
During the course of business, the Australian Football Bodies may also collect personal information that is given to them by a third party (for example, a corporate partner of an Australian Football Body or information that is on a publicly maintained record). This information forms part of the personal information described in this policy. The Australian Football Bodies will not intentionally solicit personal information that is unintentionally disclosed.
6 Storage of Personal Information
Wherever reasonably practicable, the Australian Football Bodies will store personal information on data servers that are owned and controlled by the AFL and the AFL’s community football administration platform providerand are located within the geographical borders of Australia. However, some of your personal information may be transferred, stored, processed, used or disclosed overseas by the Australian Football Bodies, or by the Australian Football Bodies third party service providers. In particular, as at the date this privacy policy was most recently updated, your personal information may be disclosed to recipients in the USA, Gibraltar, China and other countries from time to time.
This may happen if our service providers are located overseas, or if transactions, information, services or products have an overseas connection. Where such parties are located overseas, you may have rights to enforce such parties' compliance with applicable data protection laws, but you may not have recourse against those parties under the Australian Privacy Act in relation to how those parties treat your personal information.

You consent to the Australian Football Bodies using your personal Information for sending you information, including promotional material, about the Australian Football Bodies, or Australian Football Bodies' products and services, as well as the products and services of third parties, now and in the future. “AFL Online” refers to the AFL website with its top-level domain located at http://www.afl.com.au/, all related sub-domains for State Leagues and any other AFL website (including any AFL Club website) which provides an AFL and AFL Club product, AFL and AFL Club service or AFL-related product or service including related mobile applications. You need not disclose your identity to us in order to visit AFL Online, except where personal information is voluntarily supplied, however our internet server may automatically record details about any computer used to access the website (such as the IP address, domain name and browser type), the date and time of access, and details of the information downloaded. This information is used for internal statistical purposes and to improve AFL Online.

The Australian Football Bodies may use “cookies” on AFL Online. A cookie is a small text file that AFL Online may place on your computer. Usually, cookies are used as a means for our websites to remember your preferences and are thus designed to improve your experience of AFL Online. Cookies may collect and store personal information about you.

If you are under 18, you should only use AFL Online with involvement of a parent or guardian. 9 Information Security
The Australian Football Bodies will take reasonable steps to protect all personal information within their direct control from misuse, interference, loss, unauthorised access, modification or disclosure. The Australian Football Bodies will take reasonable steps to hold information securely in electronic or physical form in access controlled premises or in electronic databases requiring logins and passwords.
10 Notifiable Data Breaches Scheme
In the event of any loss, or unauthorised access or disclosure of your personal information that is likely to result in serious harm to you, the Australian Football Bodies will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with the Privacy Act 1988 (Cth).
11 Contacting the AFL Regarding Access & Correction and Privacy Complaints
The privacy laws of some jurisdictions give individuals the right to access, amend or delete their personal information or, in some circumstances, to restrict or object to the processing of their personal information.

The following additional conditions apply to the prize: (a) if a minor participates in any other part of the prize he/she must be accompanied by a parent or legal guardian over the age of 18 years; (b) The Prizes cannot be transferred, exchanged or redeemed for cash. (c) If the Winner cannot attend the event on the dates offered by the Promoter then, at the Promoter’s discretion, the Winner and any travel companions will forfeit all rights to attend the event and no cash or alternative tickets will be awarded in lieu. (d) The Winner acknowledges and agrees that their attendance (and the attendance of their guests) at the event is subject to the conditions of entry at venue(s). For an entry to be deemed valid (an Entry), an entrant must, during the Promotion Period register their Entry by: Eligible Entrants must: To enter, during the Entry Period entrants must be the recipient of an email from the Promoter: 1. Visit the digital entry form hosted by the Promoter between 11/03/24 and 11/08/24 entitled KICK YOUR WAY TO L.A. and complete the online entry form, submitting responses with contact details for the purposes of administration of the Promotion. 2. All valid entrants will remain in the Prize Draw until the Promotion Close Date. 3. Entrants can only enter the Promotion once. 4. Entrants must adhere to the Eligible Entrant requirements; 5. Consent to the collection and use of your personal information, being your name, mobile number, email address (and other personal information as set out in the terms and conditions) (of you or your parent or legal guardian as the case may be) in accordance with these terms and conditions. |
Judging |
A. Game of Skill: The Promoter or its nominated representative will pre-select one (1) participant via the Adelaide Crows’ official social media platform for each Match Day during the Promotion Period (total 11). Entrants will be chosen based on a written entry of 25-words or less. Selecting the Entrants will be based on the following equally weighted criteria exercised at the discretion of the Promoter or their nominated representative: · Creativity; · Originality; and · Passion the Entrant displays for the Adelaide Crows. B. Game of Skill: The chosen Entrants for each Match Day will compete in the ‘Crypto.com challenge’. Each winning Entrant will have three opportunities to kick for a prize at the basketball ring. If unsuccessful, the Entrant may accept the minor prize. The Entrant will win if the Entrant: · kicks a football into the basketball ring from 15 metres away. If the Entrant is not successful at any station, prizing is forfeited and resets for the following game. |

TERMS AND CONDITIONS OF ENTRY
1. Entries must be received by the Promoter during the Promotional Period. Entries received after the close of the Promotional Period will not be accepted.
2. Entrants must be a resident of South Australia.
3. This competition is a game of skill. Chance plays no part in determining the winner.
4. By entering the Promotion, you guarantee that you have the authority to accept these Terms and you agree to be bound by the Terms. A copy of these Terms and Conditions will be available at the Promoters website page.
5. Prizes are not transferable and are not redeemable for cash. In particular, Prizes may not, without the prior consent of the Promoter be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If the Promoter suspects any Entrant to be in breach of this clause, the Promoter or the Supplier may, at their absolute discretion, withdraw the Prize and cancel the Promotion. Where a Prize has been withdrawn in accordance with this clause, no refund, substitute or compensation will be offered.
6. The Promoter accepts no responsibility for late, incomplete, lost or misdirected entries or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches, theft or destruction, any cause beyond the Promoter’s control, or unauthorised access to or alteration of the competition. The Promoter may modify, cancel, terminate or suspend the competition. Further, the Promoter at its sole discretion may recommence this competition under the same or similar conditions.
7. If any Prize (or any part of the Prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a Prize (or part of the Prize) of equal or greater value.
8. In the event of war, terrorism, state of emergency, pandemic, government issued directive or order or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a Prize, subject to any necessary approval by the state/territory gaming authorities.
9. If this Promotion cannot run as planned for any reason beyond the Promoter's control, for example due to government-imposed restrictions, software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
10. The Promoter is not responsible if the Entrant is unable to travel on the specified date/s to access the Prize or elements of the Prize, due to government travel restrictions or any other cause beyond the Promoter's control. The Promoter accepts no responsibility if one or more of the events or activities awarded as part of the Prize are abandoned, called off or postponed for any reason. In that case the Entrant and any companion/s forfeit their entitlement to that event/activity as a part of the Prize. Similarly, while the Promoter will make all reasonable efforts to ensure the participation of any specified celebrity/ies in the Prize element/s, the Promoter and Prize suppliers exclude, so far as legally permissible, all liability if for any reason the celebrity/ies do not attend the Prize element/s due to circumstances beyond the reasonable control of the Promoter and Prize suppliers (e.g. illness). Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this or any other altered Prize element.
11. If an entrant’s contact details change at any time between the date on which they enter the competition and the end of the Promotional Period, that entrant must notify the Promoter of their correct contact details immediately.
12. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this competition. Verification is at the discretion of the Promoter; whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, is in breach of these conditions, provides entries that are offensive or otherwise inappropriate in the sole opinion of the Promoter, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this competition, or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
13. The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a Prize or in relation to the competition, except for any liability which cannot be excluded by law. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
14. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
15. If consumers are required to purchase a product to enter, then it is a condition of the Prize being awarded to the winner that the winner retain a clear copy of their original receipt and provide it to the Promoter as proof of a valid purchase to enter this competition.
16. If in the conduct of this competition, the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Competition and Consumer Act 2010 (Cth) or is implied by any other commonwealth, state or territory law that cannot by law be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or Prize won.
17. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the Prize.
18. By entering the Promotion, an Entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the Entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an Entrant entering or participating in the Promotion, winning or failing to win a Prize, or using or permitting any other person to use the Prize (except for such liability which cannot be excluded by law).
19. Before the Prize is awarded, the winner and any other person(s) sharing the Prize with the winner may be required to sign an agreement to release the Promoter from any liability arising from the use or participation in the Prize.
20. Entrants consent to the Promoter using their name, image and/or voice if they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
21. By entering this competition, Entrant’s consent to the collection, use and disclosure of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter’s privacy policy can be viewed at the link in the Schedule.
22. It is a condition of accepting any Prize that the winning Entrant must comply with all the conditions of use of the Prize, including conditions of entry to any event as a part of the Prize and the Prize supplier’s requirements. The Promoter may in its absolute discretion cancel a Prize or otherwise cease to provide any benefit of a Prize to a winning Entrant and/or companion if the winning Entrant, and/or companion in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate (or of the business of the Promoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate during the Promotion Period or in the course of attending or using any Prize awarded (or any part of the Prize) or provided by the Promoter. Each Prize must be taken as stated and no compensation will be payable if a winning Entrant is unable to use the Prize as stated.
23. If a Prize-winning Entrant has not confirmed their availability to take the Prize on the specified dates by the specified time, the Prize-winning Entrant’s entry will be deemed invalid. The Promoter reserves the right to conduct a further draw to award the Prize, subject to any directions given by any relevant authority in accordance with the Unclaimed Prize draw in the Schedule.
24. These conditions are governed by the laws of South Australia.

34. The following additional conditions apply to the "AFL experience" part of the prize:
(a) if a minor participates in any other part of the prize he/she must be accompanied by a parent or legal guardian over the age of 18 years;
(b) if the winner does not take the prize, or any part of the prize, during the time period stipulated, then the prize, or that part of the prize not taken, is forfeited and cash will not be awarded in lieu of the prize;
(c) all ancillary and travel costs are the winner's and/or companion's responsibility – no travel and ancillary costs form part of the prize;
(d) all tickets are valid for the date as indicated on the tickets and are subject to the conditions stipulated by the provider of the tickets;
(e) the winner and any companion will be required to abide by any dress codes and/or instructions with respect to the events and behave responsibly including the responsible consumption of alcohol, no prohibited drugs or medication, no aggressive or offensive behaviour, or behaviour which may diminish the enjoyment of any of the events by any other person or behaviour that may diminish the good name or reputation of the Promoter and the Promoter may in its absolute discretion cancel a prize or otherwise cease to provide any benefit of a prize to a winner and/or companion if the winner, and/or companion in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate (or of the business of the Promoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate; and
(f) if any part of the "AFL experience" is abandoned, called off, varied or postponed for any reason, then at the Promoter's sole discretion, the winner and their companions forfeit all rights to attend the relevant event and no cash or alternative tickets will be substituted for that element of the prize.
35. If the Major Prize (or an element of a prize) is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize (or an element of the prize) for a prize of equal or greater value, at its sole discretion, subject to state regulations.
